RENTAL AGREEMENT The following agreement and accompanying Terms and Conditions of Rental binds a contract between the above named party and :

 

The property rented in this agreement is known as WALKER COTTAGE Maximum number of occupants – 8

1. Tenant agrees to vacate rented premises no later than the hour and date shown in the booking terms.

2. Unit must be cleaned at the end of your stay – see below.

3. No visitors or unregistered guests allowed on premises. No parties are allowed.

4. Must be quiet by 11:00pm. (City By-laws)

5. Fireworks are Not Permitted as per (City By-Laws)

6. Utilities: THE OWNER will provide THE RENTER with water, heat, electricity, linens. All utilities are included in the total rental price.

7. Restrictions: Smoking is not permitted inside the Cottage, or within 15 feet of any window/ or door.

8. No use of hair dye is allowed in home please.

9. Walker Cottage is pet friendly but visiting pets must be pre-approved by owner prior to booking. All pets must be fully house broken. No pet may be left alone or unsupervised in the house or on the premises. Pets are not allowed on the furniture.  A $200 (refundable) pet damage deposit is required.

10. Damage/Security Deposit: The cost of any damage caused by THE RENTER (or their registered guests) will be deducted from the damage/security deposit. THE RENTER will be responsible for any damage caused in excess of the damage deposit and will be invoiced separately. Any evidence of smoking in the home will result in automatic loss of entire damage/security deposit plus may result in additional fees. Any breach in rental agreement will result in loss of entire damage/Security deposit and may result in immediate eviction.

 

10.a. The damage/security deposit will be returned to THE RENTER by THE OWNER after the owner has inspected the property. Refund of damage/security deposit may take up to 5 business days to process

11. General Conditions: The maximum number of guests using the rental premises shall not exceed the total number stated in the cottage rental agreement (8 guests maximum). All guests names must be registered with owners at time of booking. Minimum age of renters, 30 (excluding children).

 

12. THE RENTER shall keep the property in a state of cleanliness and in good condition and repair. THE RENTER acknowledges that at commencement of the rental, the property is in good and substantial repair except for any defect THE RENTER may report to THE OWNER’s representative during the first day of the rental. THE RENTER shall leave the property in good repair, cleaned and vacuumed, dishes washed, beds stripped, all garbage must be put in garbage bags (provided) and placed in bins in parking area.

 

13. Any unsafe or dangerous condition must be reported to THE OWNER or their representative immediately. The renter acknowledges that the use of the property is entirely at the renter ’s risk. The renter shall indemnify THE OWNER against and from any and all expenses, costs, damages, suits, actions or liabilities arising from any and all loss of or damage to personal property, injury or death resulting from the use of the rental property, grounds, hot tub and lake use.

 

The renter assumes full responsibility for fulfilling the terms of the rental for the period stated. Signatures:

14. In the event that any guest or pet is unruly, violates the noise by-law, the owner receives a complaint regarding renters conduct during their stay, or there is any breach in the rental agreement, owner shall have the right to ask them to leave the premises immediately with no refund of monies paid (rental payment and damage/security deposit).

 

– Owner reserves the right to enter the home (during a guests stay) to make repairs or to inspect the unit if deemed necessary.

 

– Tenant agrees to maintain the property in the same condition in which it was found. Reasonable wear and tear is taken into consideration

 

.- Tenant agrees to replace or pay for losses, breakage or damage should such occur.

 

– Tenant agrees to clean and leave the home in the same condition in which it was found (checklist on premises). If home is not maintained and clean when tenant vacates, A minimum of $200.00 will be deducted from the damage/ security deposit.

 

– OWNER SHALL NOT BE RESPONSIBLE FOR DAMAGE OR LOSS OF TENANTS PERSONAL PROPERTY (including vehicles)- OWNER SHALL NOT BE RESPONSIBLE FOR PERSONAL INJURY TO TENANT.

 

– Mechanical failure of any kind will be remedied by owner as soon as possible, once reported to owner by tenant. Owner cannot guarantee a specific time frame for repairs should a mechanical issue arise.

 

– THIS AGREEMENT TERMINATES IF PREMISES ARE DESTROYED BY FIRE, OTHER CASUALTIES OR ACTS OF GOD- FULL REFUND FOR MISSED RENTAL PERIOD WILL BE MADE UNDER THESE CONDITIONS.
